LEAD BUYER MASTER SERVICE AGREEMENT
Mover Participation Agreement
Effective Upon Electronic Acceptance
This Lead Buyer Agreement (“Agreement”) is entered into by and between Q Moving Leads (“Company”) and the enrolling moving company (“Buyer”).
1. ACCEPTANCE OF AGREEMENT
By submitting the registration form, clicking “I Agree,” receiving any lead, or answering any call delivered by Q Moving Leads, Buyer enters into a legally binding agreement and accepts all terms herein.
2. LEAD LICENSE & OWNERSHIP
All leads remain the exclusive intellectual property of Q Moving Leads. Buyer is granted a single-use, non-transferable license to contact the consumer for the specific job inquiry only.
STRICTLY PROHIBITED:
• Reselling
• Re-sharing
• Syndication
• Uploading to third-party marketplaces
• Transferring to agents, affiliates, or subcontractors
Penalty: $2,500 liquidated damages per lead, plus immediate termination.
3. PAYMENT OBLIGATION (NO EXCEPTIONS)
Buyer agrees to pay for every lead delivered by Q Moving Leads, regardless of:
• Job size
• Quote amount
• Outcome
• Buyer availability
• Customer choice
• Missed or unanswered calls
• Buyer delay
4. ONLY VALID DISPUTES
Credits or refunds are granted only if:
✔ Phone number is disconnected / not in service
✔ Consumer explicitly confirms they are not moving at all
All other reasons are invalid.
5. AUTOMATIC PURCHASE RULE
Any answered call exceeding 60 seconds, any completed form submission, and any unanswered call is considered a confirmed and chargeable purchase.
6. IRREVOCABLE PAYMENT AUTHORIZATION
Buyer irrevocably authorizes Q Moving Leads to automatically charge the payment method on file for:
• Delivered leads
• Service fees
• Reattempt fees
• Outstanding balances
Authorization remains valid until all balances are paid.
7. DIGITAL PRODUCT & NON-REFUNDABLE POLICY
All leads are classified as custom digital products and are:
• Non-returnable
• Non-refundable
• Not subject to reversal
8. STRIPE / PAYPAL / CARD DISPUTE WAIVER
Buyer waives all rights to chargebacks, disputes, and reversals through:
• Stripe
• PayPal
• Banks
• Credit card networks
Any dispute attempt constitutes breach and triggers:
• $250 dispute handling fee
• $500 liquidated damages
• Immediate termination
• Collections & legal recovery
9. DELIVERY & ACCEPTANCE PROOF
Buyer agrees that the following constitute legal proof of delivery and acceptance:
• Call recordings
• Call logs
• IP logs
• Timestamps
• CRM delivery logs
• SMS / Email delivery confirmations
10. COMPLIANCE REQUIREMENTS
Buyer agrees to:
• Contact each lead within 5 minutes
• Comply with TCPA, CAN-SPAM, and Do-Not-Call laws
• Not misrepresent Q Moving Leads
• Treat consumers professionally
11. TERMINATION
Q Moving Leads may terminate Buyer immediately for:
• Payment failure
• Dispute abuse
• Lead misuse
• Low answer rates
• Any breach of this Agreement
All unpaid balances become immediately due.
12. GOVERNING LAW & VENUE
This Agreement shall be governed by United States Commercial Law.
All disputes shall be resolved in the jurisdiction selected by Q Moving Leads.
13. BINDING ELECTRONIC ACCEPTANCE
